Le Paris de Sophie is a sole proprietorship whose head office is located at 19 Rue Beccaria – 75012 PARIS identified at the SIREN under the number 878 533 108 (hereinafter « Le Paris de Sophie ») which offers Users of the website www.leparisdesophie.com a service enabling them to book experiences – sightseeing tours – in the city of Paris but also to be advised in the preparation of their trip to Paris (the « Services »).

 

Contractual information is presented in French and English, the French language being authentic.

 

  • ARTICLE 1 – Object

 

The present General Terms and Conditions of Sale (the « General Terms and Conditions of Sale ») govern relations between Le Paris de Sophie and any non-commercial natural person (« the User ») on the occasion of the sale of services presented on the www.leparisdesophie.com website.

 

Any order and payment for the purchase of an experience or an invoice/quotation relating to travel advice implies adherence to these Terms and Conditions, which you may print and keep.

 

Le Paris de Sophie reserves the right to adapt or modify the General Terms and Conditions of Sale at any time. The General Terms and Conditions of Sale thus modified will then be applicable in place of the former General Terms and Conditions of Sale as soon as they are put online on the www.leparisdesophie.com website.

 

In accordance with the regulations in force, Le Paris de Sophie reserves the right to derogate from certain clauses of these General Terms and Conditions of Sale, depending on the negotiations conducted with the User, by establishing special conditions.

 

  • ARTICLE 2 – Services

 

Le Paris de Sophie offers a service of guided experiences to allow Users to discover Paris as a place and in an original way.

 

– Le Paris de Sophie has created different experience offers, all detailed on the website. The User buys on a specific date and at a defined time slot the guided tour he or she wants to carry out with Le Paris de Sophie.

 

– In addition, Le Paris de Sophie guides the User through the activities that he or she could carry out during the trip to Paris and makes suggestions based on his or her wishes. These address books and travel itineraries are in the form of a PDF document, sent by email to the User.

The User remains the sole final decision-maker in the choice of his travel services (restaurants, museums…), the provider’s suggestions are not binding.

The travel service providers (restaurants, museums…) suggested by Le Paris de Sophie are identified as being the most relevant to meet the User’s needs.

 

  • ARTICLE 3 – Prices

 

The Services offered by Le Paris de Sophie are provided at the rates in force on the Site, as communicated to the User prior to placing an Order. The prices appearing on the Site are expressed in Euros and include all taxes.

 

The displayed Price corresponds to the Price of a reservation for one person within the framework of an experience or the number of addresses indicated on the Site for the address book.

 

The prices include the services of the guide and the options included in the description of the experience (food, drinks…), as well as the booking fees.

Prices are contractual rates. No dispute regarding the price of the Service will be taken into account once the Order is effective (confirmation by email).

 

  • ARTICLE 4 – Terms and conditions of order

 

For an experience, the User can book and pay online at www.leparisdesophie.com.

 

To request an address book or personalized itinerary, the User must contact Le Paris de Sophie by email at leparisdesophie@gmail.com.

 

A questionnaire is then sent to the User, and it is mandatory for the User to answer it as precisely as possible in order to provide Le Paris de Sophie with the data necessary to prepare the User’s project and the estimate corresponding to his/her request. Any incomplete request will not be processed. Upon receipt of the questionnaire, Le Paris de Sophie will send one or more estimates to the User in order to begin the creation of the address book or personalized itinerary. Once the quote has been selected, the User must pay the total amount of the service in order for Le Paris de Sophie to begin its research.

 

The search will be carried out via several means (internet and the local experience of Le Paris de Sophie) in order to select different activity addresses corresponding to the User’s expectations and budget. If the User’s initial request does not match the document, it can be modified once at no charge, subject to notification to Le Paris de Sophie within 2 working days of receipt of the document. Beyond the number of modifications or the specified deadline, the User will have to pay €10 per modification of the document.

 

Le Paris de Sophie has 15 working days from the date of the quote validated by the User to provide the personalized itinerary.

 

After sending by email the address book/personalized itinerary containing the addresses of the places chosen by Le Paris de Sophie, the User is free to use this advice as he or she sees fit.

 

  • ARTICLE 5 – Methods of payment

 

For experiences, the price is payable in full on the day the order is made by the User, according to the terms and conditions specified in article 4 of the GCS, solely by secure payment by credit card through the Stripe platform.

The payment of address books and personalized itineraries can also be made by credit card through the Stripe platform.

 

The price for the address books and personalized itineraries is payable by the User in full upon receipt of the invoice. The invoice will be issued by Le Paris de Sophie after receipt of the duly completed questionnaire and validation of the quote issued by Le Paris de Sophie. Le Paris de Sophie begins the creation of the personalized service and has 15 working days to communicate the final result.

Le Paris de Sophie will not be obliged to provide the Services ordered by the User if the User does not pay the price in accordance with the terms and conditions indicated in these General Terms and Conditions of Sale.

 

The payment made by the User is only considered final after Le Paris de Sophie has received the sums due.

 

  • ARTICLE 6 – Cancellation and right of withdrawal

 

For experiences, by virtue of article L.221.-28 12°) of the Consumer Code and taking into account the na ture of the services provided, the User does not benefit from the right of withdrawal:

« The right of withdrawal cannot be exercised for contracts : (…) 12° For the provision of accommodation services, other than residential accommodation, services for the transport of goods, car hire, catering or leisure activities which must be provided on a specific date or at a specific time ».

 

The contract is therefore concluded definitively as soon as the User places the Order in accordance with the terms and conditions specified in these GCS.

Any order for an address book and personalised itineraries placed by the User is firm and definitive: no cancellation or refund is possible after the order has been placed in accordance with the terms and conditions set out in Article 4 hereof.

 

Any Service provided that is incomplete due to the User’s wishes will not be refunded on a pro rata temporis basis (including if the User is late or wishes to terminate the Service). In the event of early termination by the User, all remaining sums that may be due by the User shall be immediately payable, without prejudice to any damages and interest and other remedies.

 

In the event that Le Paris de Sophie is unable to perform an experience in optimal conditions for the User due to an event of Force Majeure, another slot will be offered by Le Paris de Sophie. In the event of material impossibility to find another slot, the experience will be cancelled and fully refunded.

 

It being agreed between the Parties that a Force Majeure event is an unpredictable, irresistible, and external event, including in particular the following events: strikes and public demonstrations, illness, death, exceptional weather conditions, natural disasters etc., the User will not be entitled to a refund.

 

  • ARTICLE 7 – Responsability

 

Participants in the experiences are under their own responsibility in the event of an accident.

LE PARIS DE SOPHIE DECLINES ALL RESPONSIBILITY IN CASE OF ACCIDENT OR THEFT DURING THE EXPERIENCES.

 

Le Paris de Sophie undertakes to provide the Services diligently and according to the rules of the art, it being specified that it has an obligation of means, to the exclusion of any obligation of result, which the User expressly acknowledges.

 

Le Paris de Sophie cannot be held responsible for the failure to visit a museum, to book a restaurant, or to close a place outside the hours indicated by Le Paris de Sophie.

In the event of a dispute between one of the recommended addresses and the User, Le Paris de Sophie cannot be held responsible or be a party to the dispute.

 

Neither can Le Paris de Sophie be held responsible for the poor progress of a stay, a bad experience of activities or services, an accident during a recommended activity, climatic or economic problems. The reservation and the choice of the activity will be the sole will and responsibility of the User. The service offered by Le Paris de Sophie is only an advisory service in terms of holiday planning.

 

Le Paris de Sophie does not guarantee Users that the organization and planning of the trip, which is subject to constant research to improve its performance and progress, will be totally free of errors, defects or faults, and that the Consultancy Services will specifically meet all their needs and expectations.

 

Le Paris de Sophie cannot be held responsible for, inter alia :

– the failure of an activity provider chosen by the User.

– an error caused by a lack of information or erroneous information provided by the User

– a delay caused by the User that would result in the impossibility to respect the agreed deadlines or those prescribed by law.

 

  • ARTICLE 8 – Dispute Resolution and Jurisdiction

 

If you do not comply with any of the provisions of these terms and conditions of sale and, in general, any difficulty affecting the execution, interpretation or validity hereof, shall be subject to French law and the French courts.

 

  • ARTICLE 9 – User Acceptance

 

The present General Terms and Conditions of Sale are expressly approved and accepted by the User, who declares and acknowledges having read them and having perfect knowledge of them, and therefore waives the right to rely on any contradictory document and, in particular, his/her own general terms and conditions of purchase, which will be unenforceable against Le Paris de Sophie, even if he/she is aware of them.
